Terms of sale and use.

The agreement between you and Peter Gombos, who makes and sells Groove OS: buying it, your account, and using it on your FM-1. Written to be read. If anything is unclear, write to pepegombos@gmail.com.

Who sells Groove OS

Groove OS is sold by Peter Gombos, an individual based in Hungary (Berc utca 14, 1015 Budapest, Hungary), reachable at pepegombos@gmail.com. In these terms “we” and “us” mean him, and “you” means the person who buys or uses Groove OS. The full details are in the legal notice.

What you buy

A personal licence to use Groove OS 1.x on M-VAVE FM-1 units that you own. It includes every 1.x release we publish (1.0, 1.1 and so on), each installed from the same page. We intend to keep improving Groove OS, but we do not promise a particular update or a date for one. A later major version (2.0) may be sold separately; if it is, what you already have keeps working.

To use it you need an FM-1 running M-VAVE's firmware V15, a USB data cable, and Chrome or Edge on a computer. Check this before you buy: the install page and the manual say exactly what it does.

Your account

Your licence lives on your account: it is where the installer, your receipts and your downloads are. Use an email address that is yours and that you read, because it is how we reach you about your purchase. Keep your sign-in details to yourself; what is done with your account is your responsibility. You can ask us to close it at any time (see privacy).

Price and payment

The price is shown before you pay: today $29, once. There is no subscription and nothing renews. Payment is taken by Stripe; we never see your card details. If your card is in another currency, your bank may add a conversion fee.

Delivery: access straight away

Groove OS is digital content, delivered at once. As soon as the payment goes through, the installer is unlocked on your account and you can install. At checkout you agree to these terms and ask for that access straight away.

Refunds

Within 14 days of your purchase you can ask for a full refund: write to pepegombos@gmail.com. We refund the full amount to the original payment method, and the licence and your account's access to downloads and updates end with the refund. The refunds page has the details.

The licence

Groove OS is proprietary software. When you buy it you get a personal, non-transferable licence to install and use it, with every 1.x update, on FM-1 units you own. Everything else stays ours, and the firmware files the installer downloads also contain M-VAVE's own V15 firmware, which is not ours to give out. So:

  • Install and use Groove OS on FM-1 units you own, as often as you like.
  • Do not sell, share, upload or publish the firmware files the installer downloads, and do not let others download through your account.
  • Do not get around the account check that controls the downloads.
  • Do not copy, modify, decompile or reverse engineer Groove OS, except where the law allows it regardless of these terms.

Independent software

Groove OS is independent software. It is not made, endorsed or supported by M-VAVE, and we are not affiliated with M-VAVE in any way. M-VAVE, FM-1 and other names are trademarks of their owners, used only to say what Groove OS runs on. Questions about Groove OS come to us, not to M-VAVE.

Installing firmware is at your own risk

Putting firmware from anyone but the manufacturer on a device is your choice, made at your own risk and responsibility. We test every release on real units and the installer checks every file before it writes it, but no install can be guaranteed. Before you install:

  • Export your projects first.
  • Follow the steps on the install page, and keep the cable connected and the page open until it says it is done.
  • Know that installing third-party firmware may affect the manufacturer's warranty.

The same page puts M-VAVE's V15 back on, and the firmware chapter of the manual describes the recovery for a unit that does not start.

Warranty

Groove OS is provided as it is. We take care that it does what this site describes, and we fix the faults we can reproduce, but we do not promise that it is free of faults or suits every purpose. If you buy as a consumer, your statutory rights for digital content that does not conform to its description still apply, and nothing here takes them away.

Limitation of liability

To the extent the law allows, we are not liable for damage to a unit, lost data or projects, a unit that stops working, or any indirect or consequential loss, and our total liability to you is limited to the amount you paid for Groove OS. This does not limit liability for death or personal injury caused by negligence, for intent or gross negligence, or for anything else the law does not allow to be limited.

Your rights as a consumer

If you buy as a consumer, the mandatory consumer law of the country you live in still protects you. Where these terms and that law differ, the law wins.

Governing law

These terms are governed by the law of Hungary. If you are a consumer, you keep the protection of the mandatory law of your own country, and you can bring a claim in the courts where you live.

Changes to these terms

We may change these terms, for example when the law or Groove OS changes. The date at the top says when they last changed. The terms you agreed to when you bought apply to that purchase; a change never takes away something you have already paid for.
